Your Rights When Arrested

El Paso Criminal Defense Law Firm Tips for the Arrested

Real Damage Control Immediately After Your Arrest

If you get arrested, it probably means one of two things—you just got caught by some real bad luck or you were making some poor decisions.

Miguel Cervantes, criminal law attorney in El Paso, can help, but when you’re still on the scene, you can do a few smart things for yourself to control the damage immediately after your arrest.

Suggestions from an El Paso Criminal Attorney

Do not talk to the police.

You cannot talk your way out of being arrested; however, you can annoy an officer into being particularly brutal with you or dig an even deeper hole for him to fill with more charges by telling him things you do not have to tell him. Stay quiet and cooperative and, if you do choose to speak, be exceptionally polite.

Do not believe everything the police say to you.

The police lie. They are allowed by law to lie to you to get you to confess to a crime or to get information from you that they think will help them incriminate you. Remember, too, that the police cannot reduce or dismiss charges against you, because you told them something. Only the prosecutor can reduce or dismiss charges.

Make mental notes of everything.

It may be helpful for us to have information about the scene and the events leading up to the arrest. Think like a journalist or a detective—you never know what could be an important later or how pieces of information you can tell our office may influence your case for the better.

Call an attorney ASAP.

The sooner our law firm gets involved, the better your chances are of controlling the fallout of an arrest. An arrest does not have to lead to a criminal charge in all cases. The review process may turn up something that clears you—our office helps mitigate the effects of the arrest quickly.
